The Sindh High Court (SHC) objected to the Sindh provincial government’s conversion of the Guzara allowance to a Benazir Muawinat card, and held that “the province cannot use Zakat funds to gain political miles”.

The High Court observed that zakah is the money of citizens, deducted from their accounts every year, and can only be provided to eligible people who meet the standards set by Sharia law.

The bench observed that neither the Zakat committee nor anyone else, including the government, could raise objections to the distribution standards of Zakat. Therefore, the recipient must be qualified, otherwise it will be presented to any unqualified Zakat personnel. penny. Funds are not only illegal, but also make offenders bear legal consequences.

SHC stated that the distribution of zakah called Benazir Muawinat Cards is shocking because it clearly gives the impression that the government provides such assistance, which is not the case with the distribution of zakah.

The High Court instructed the Sindh provincial government to issue a new plan through its other funds because the province cannot use the Zakat funds to earn political miles. The bench instructed the secretary of the Zakah committee to make a record and submit a report detailing when they introduced the Guzala allowance called Benazir Muawinat card and why it was necessary to convert the allowance into a card.

The Attorney General (AG) of Sindh submitted a compliance report which mentioned that the financial department has issued funds due to the biometric verification of the Benazir Muawinat cards of 100,000 beneficiaries of the National Database and Registration Agency (Nadra).

Regarding dowry funds, the Attorney-General proposed that any girl living in Darul Aman or any shelter, whether private or public, is eligible to receive dowry/Jahez funds directly or through the person in charge, and these funds will be viewed through cross-payment . He proposed that although Shun Tak Bank’s processing of crossed cheques and issuance of amounts is temporary, it should be done through a biometric system.

The secretary of the Zakat Committee suggested that the department had launched a website to comply with the court’s order. After perusing the report of the Zakah Committee, SHC observed that it was shocking that the committee had been providing funds to public universities for four years, but despite the court order requiring the university to open a window on their website and form a committee , To provide zakaah to the students who deserve it.

The High Court observed that the Zakat Committee has been asking public universities to provide account details and receive payments. Surprisingly, only a few universities received payments, but they did not use the funds.

The judge observed that only one university notified the secretary of the Zakat Committee of the refund amount because the amount was not used. It pointed out that the doors of public universities must be open to worthy people/students. The High Court instructed the registrars of public sector universities and other institutions to submit a response regarding the unused Zakat funds.

SHC observes that public universities should prepare a mechanism. If necessary, officials of the Zakat Council have the right to oppose their mechanism, and universities should keep records of Zakat on their website.
